    林显福诉玉环县迅达集团公司应承担受委托为其所雇雇工的工伤赔偿责任案

     【案情】
     原告:林显福。
     被告:玉环县迅达集团有限公司(下简称迅达公司)。
     被告:郑达赞。
     1997年上半年,被告迅达公司因扩建厂房和新建食堂,将所有的木工工程发包给原告林显福,双方约定报酬每工以58元计。原告接活后,又叫来被告郑达赞等5人共同干活,原告与被告郑达赞等约定每工以55元计。被告郑达赞等人在工作期间均由原告指派、安排具体工作事务。
     被告迅达公司的门卫将每天的做工人数均记录在原告林显福身上。1997年6月17日,原告向被告迅达公司领得一个多月的酬金17727元后,支付给被告郑达赞等人。1997年5月9日,被告郑达赞与原告等人一起架设食堂的人字架时,被告郑达赞脚踩在墙头流水沟的水槽板上,因水槽板保养期未过,被告郑达赞从墙头摔下。尔后,被告郑达赞到玉环县第二人民医院、温州医院第二附属医院治疗达18天。医院诊断其为:第十二骨椎分裂、凸出,医生要求其出院后卧床休息二个半月,避重劳动一年,期间被告也有门诊治疗。为此,被告郑达赞共花去合理医疗费561130元。为被告郑达赞经济损失的承担,三方经多次协商未达成一致意见。1998年4月1日,被告郑达赞向玉环县劳动仲裁委申请劳动仲裁。同年8月14日,被告郑达赞经玉环县劳动人事局鉴定为九级伤残。同年12月8日,玉环县劳动仲裁委作出裁决,认为被告郑达赞系受原告雇佣,被告郑达赞所受的伤系工伤,被告郑达赞的损失应由雇主承担责任,被告迅达公司为受益人也应承担补偿责任。据此,裁决原告赔偿被告郑达赞损失13721.88元,被告县迅达公司补偿11259.72元。原告不服此裁决,向玉环县人民法院提起诉讼。称:其同被告迅达公司不是包工包料关系,而是点工关系。被告郑达赞在被告迅达公司做木工,是受被告迅达公司建筑上的需要而委托雇工,不是其承包木工工程直接雇佣。所以对被告郑达赞的伤害后果不承担责任。
     被告迅达公司答辩称:公司因扩建厂房和新建食堂将木工工程发包给原告施工,一工以58元计算。被告郑达赞系原告雇佣,其工作内容由原告安排。1997年5月9日,由于原告未管理好,致使郑达赞受伤。在县劳动仲裁委仲裁时,公司考虑到自己为受益人适当承担补偿责任,故同意仲裁委的仲裁结果。
